Terms of Service

By commissioning me you are agreeing to the following terms. Please read carefully.

Contact:

Please contact me at: anavillegasart@gmail.com for all inquiries.

All communication regarding work is to be done through e-mail, or discord if requested.

Payment:

  • All payments should be in EUR. Via Paypal. I’ll be in charge of sending the invoice to the client.

  • Payment can be made in several payments for the client convenience: 50%-50%, 30%-40%-30% or similar, depending on the required work, being the first payment made upfront. Client can discuss this with me.

General guidelines:

  • General commissions are only for personal use.

  • The prices I have specified are only used as guidelines, and it may change depending on the final result you would want to require.

  • I reserve the right to decline a project for any reason.

  • I won’t work for any blockchain or NFT project related, and I don’t consent to the use of my work for such purposes.

Process:

The process may vary from every work, but it will always take a similar scheme:

First ideas - Sketch - Lines - Color - Lights and shadows

  • After the first payment is received, I will start working and send several sketches to have more than one option to work with. I will discuss with the client what is the best one, or what changes I need to make.

  • Once the main composition or idea is selected, I’ll work on the final sketch where I can start detailing some parts of the piece.  Here’s the stage of the process where big changes like character pose, clothing, hair, weapons, etc, can be done. After the sketch is confirmed by the client I’ll move to the next stage.

  • After the sketch I’ll make the lineart of the piece, following with base colors. These steps usually go together to see a nearly finished look of the piece. Second payment usually goes after this step is confirmed so I can continue working on the piece. I can only make minor changes on this stage, and any major changes would result in an extra cost of 10€ per extra working hour.

  • I will be in charge to notify the customer when each payment should be sent, since sometimes the process may vary from the standar. The HD files will be sent only after the payment is 100% complete.

  • I’ll send as many WIPs as the client needs along the whole process. I usually send WIPs everytime I move from one step to another or if I've done big changes to the piece, so I won't continue working without the approval of the client.

  • The process of my work usually takes about one-two weeks for simple projects, or it can take more than a month in the case of big pieces. The working time varies depending on the difficulty, the waiting time for confirmations from the client, or from external agents who would be notified in advance. An agreement will be made between the two to estimate the approximate time depending on the specific case.

  • The client must notify me of the deadlines in advance, if any. Deadlines very close to the beginning of the job can result in an increase in the final price.

  • Size is usually A4, 300 dpi, delivered in JPG file format unless you ask otherwise. Bigger sizes may increase the final price.

Revisions:

  • I would appreciate as much details and references you would need in advance to avoid unnecessary changes. A good briefing makes the job for the artist and client much more satisfactory. A PDF or a drive documment with all the details attached is highly recommended.

  • Major changes can be only made in the sketch stage. I accept a max of 4 changes with the actual price, and any extra change would result in an extra charge of 10€/h of extra work.

  • Number of revisions for commercial use can be discussed with the client if requested.

  • I won’t allow changes after the final work is done and delivered, unless they are mistakes I’ve made by myself without noticing.

Non commercial use:

  • You may resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but you cannot alter the artwork itself.

  • You’re purchasing my artist labor and a digital copy of the final artwork. I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion, and as part of my portfolio.

  • If you do not want the work done to be shown in public or posted online, please tell me about the details privately.

  • If uploaded to any social media or platform, I must be credited for the work.

  • I reserve the right to reuse sketches and design elements that were rejected by the client for another work, or personal use.

  • I won’t allow any commercial use of the art made unless me and the client have agreed to it.

Refunds and canceling:

  • If you wish to cancel the work during the sketch stage you will be refunded 50% of what you’ve paid.

  • If you wish to cancel your commission after the sketching stage, there will be no refund.

  • You’ll receive a full refund if for any unjustifiable reason I’m unable to finish the work.

  • I reserve the right to cancel the work if the client breaks any of the established points in our agreement, with no refunds of the payment and recovering the full rights of the work done.

If the client has anything to discuss regarding these terms of use guidelines, please communicate it to me prior working together.

This document can and will be edited at any time without the need of further notice.
